PETITION FOR VOLUNTARY RESIGNATION OF WINDMILLS HOA BOARD MEMBERS

The jig is up. You have committed many violations as board members and used Evans management company and the HOA attorney to help you stay in power. We demand change.

We, the undersigned members of THE WINDMILLS Homeowners Association (HOA), submit this petition to formally request your voluntary resignation due to our concerns regarding the governance, transparency, and the overall management of our community.

WHEREAS:

1. The Board of Directors has failed multiple times to uphold its fiduciary duty by not acting in the best interests of homeowners. Many decisions were self-serving.

2. There has been a lack of transparency in decision-making, financial management, and communication with homeowners.

3. The Board’s actions have contributed to discord within the community, leading to dissatisfaction and distrust among homeowners.

4. Homeowners have been denied their right to participate meaningfully in the association's governance.

5. The Board has not adequately addressed homeowners’ concerns regarding the following specific issues:

o Mismanagement of funds.

o Lack of transparency in specific expense categories.

o Misinformation provided to homeowners.

o Refusal to support a community newsletter and website.

o Lack of community-building efforts, including failure to establish committees for financial, maintenance, events, recreation, education, outreach, budget, brainstorming, legal, enforcement, and other essential areas.

o Use of HOA funds to retaliate against a homeowner.

6. The current governance structure is not serving the community's best interests, and a leadership change is necessary to restore confidence and fairness in HOA operations.

THEREFORE, WE DEMAND:

  • The current Board of Directors voluntarily resign from their positions to allow for a fresh start with new leadership that prioritizes ethical governance and homeowner interests.

  • A fair and transparent election should be scheduled promptly to fill the vacant positions with homeowners committed to accountability, transparency, and equitable management of the HOA.

  • Guidelines and guardrails will be installed to ensure bad actors never control our HOA again.

  • Any outgoing Board members fully disclose financial records, contracts, and any pending matters to ensure a smooth and responsible transition.

TIMEFRAME FOR RESPONSE:
Each Board member must respond to this petition within 7 days of submission. Board members resigning within 7 days will receive favorable treatment. Failure to resign will result in homeowners pursuing further actions, including but not limited to:

  • Legal action to recover misused funds.

  • Legal actions to prosecute the board member's illegal actions.

  • Homeowners may hold a special meeting to vote on removing Board members per the HOA governing documents.

  • Public disclosure of grievances to community members, local authorities, and regulatory agencies.

By signing this petition, we express our collective will for immediate and necessary change within our HOA leadership.

SUBMISSION:
